Legal Terms & Policies

1. Who we are

bigdatarealty.com is operated by two licensees. For Florida services the controller is Big Data Realty LLC (Broker Licence BK3273196); for California services it is Vladimir A. Bugera, California Real Estate Broker (DRE #02341727), dba Big Data Realty. If you are unsure which holds your information, ask us (section 12).

2. What we collect

Forms and consultations: name, contact details, your goal, area, budget and timing, and whether you have a relationship with another agent.

Scheduling: bookings through Calendly.

Registered accounts: name, email, username, password (hashed), terms acceptance (version, time, IP), last access, and your activity in the registered area (logins, searches, listings and analyses viewed).

Engagements: the representation agreement, the analyses we deliver, and decision-log data such as stated budget and risk preferences.

CRM and communications: submissions and message history in HubSpot.

Analytics and cookies: pages visited, referral source, device and browser.

Third-party embeds (Google Maps, YouTube, Calendly) may collect technical data under their own policies.

We do not charge fees and do not collect payment details.

3. How we use it

To respond to you, schedule consultations, enter into and perform a representation agreement, prepare and deliver analyses, introduce a licensed specialist under agreement with us, operate the registered area under our MLS agreements, communicate with you, keep records the law requires, and improve the site.

4. How we share it

When we introduce a specialist, we share your contact details and the scope of your engagement with that specialist so they can act; their brokerage pays us a referral share if a transaction closes. If you already have an agent and that agent agrees to our involvement, we share the analysis with that agent. We share information with the providers that run our business (CRM, scheduling, hosting, email, analytics, e-signature) and with MLS systems as needed to deliver brokerage services and to meet MLS audit requirements. We share information when the law requires it. We do not sell your information for advertising. A referral fee can be a "sale" under some state privacy laws; we disclose it here regardless.

5. Calls, texts and email

By submitting a form with your phone number you give prior express written consent under the Telephone Consumer Protection Act to calls and texts from us, including by autodialer or prerecorded voice, which may include marketing. Consent is not a condition of any service; message and data rates may apply; reply STOP to opt out and HELP for help. SMS opt-in consent is never shared with third parties for marketing purposes. Marketing email includes an unsubscribe link.

6. Cookies

Used for functionality and analytics. Decline non-essential cookies in the banner or your browser. We honor Global Privacy Control signals as an opt-out of sale or sharing where applicable; we do not respond to Do Not Track.

7. Your rights

Wherever you live, you may ask what we hold about you and ask us to correct or delete it. Email privacy@bigdatarealty.com; we respond within 45 days. Records we must keep under broker record-keeping rules or MLS agreements are retained despite a deletion request. California residents have, where the CCPA applies, the rights to know, delete, correct, opt out of sale or sharing, and not be discriminated against.

8. Retention

Consultation, engagement, transaction and decision-log records: as long as needed and at least the Florida five-year and California three-year broker record-keeping periods. Registered-account records: at least 180 days after access expires. MLS-derived data: deleted as the MLS agreement requires and when it ends.

9. Security

Reasonable administrative and technical safeguards; no method is fully secure. We notify you of a breach affecting your personal information as Florida and California law require.

10. Children

The site is not directed to children under 13 and we do not knowingly collect their information.

11. Processing location and language

Information is processed in the United States. If we publish a non-English version of the site or this policy, the English version controls.

The effective date above is the latest revision; material changes are posted on this page.

These terms govern bigdatarealty.com. Registered areas are also governed by the Registered User Terms; brokerage services are governed by the written agreement you sign. If they conflict, the agreement prevails, then the Registered User Terms, then these.

2. Who operates the site

Florida brokerage services: Big Data Realty LLC, Broker Licence BK3273196. California brokerage services: Vladimir A. Bugera, California Real Estate Broker, DRE #02341727, dba Big Data Realty. Technology: REA Platforms, Inc., which provides no brokerage services.

3. What the site is

Information about our services, market research from public records and our own analyses, and forms to request a consultation. Consultations are free and create no obligation. No brokerage relationship, representation or fee arises from using the site or requesting a consultation; representation arises only from a written agreement.

4. Figures and analyses

Published figures are market statistics with sample size, source and date. They are not an appraisal, an automated valuation or an opinion of value for any property, and none may be used where an appraisal is required. Analyses are prepared with software under the judgment of a licensed broker; no software is a licensed agent or broker. Nothing on the site is legal, tax or investment advice. Figures may be corrected at any time; write to corrections@bigdatarealty.com if you believe one is wrong.

5. Your use

You may view and print pages for personal use. You may not scrape, crawl or copy the site by automated means, republish its content, use it to build a competing service or train a model, remove attributions, or interfere with the site's operation. Public content may be quoted with attribution and a link.

6. Accounts and forms

Information you submit must be accurate. If you give a phone number, the consent in the Privacy Policy applies. The registered area requires acceptance of the Registered User Terms.

7. Intellectual property

The site, its text, analyses, charts and code are ours or licensed to us. Listing information is owned by the supplying MLS. Third-party names and marks belong to their owners.

8. Third-party links and embeds

Links to other sites and embedded services (maps, video, scheduling) are provided for convenience; we are not responsible for their content or practices.

9. Fair housing

We comply with the federal Fair Housing Act and Florida and California fair housing law. We do not provide, and do not accept requests for, information about protected characteristics of neighborhoods or occupants.

10. Disclaimer and liability

The site is provided as is, without warranty. To the fullest extent permitted by law, we are not liable for loss arising from use of the site or reliance on its content. Nothing limits liability that cannot be limited by law.

11. Changes and termination

We may change the site or these terms at any time; the effective date shows the latest revision. We may block access for breach.

12. Law

Florida law and the courts of Miami-Dade County for matters concerning Big Data Realty LLC; California law and the courts of San Mateo County for matters concerning Vladimir A. Bugera dba Big Data Realty. Non-waivable consumer protections of your home state are unaffected.

Bugera, California Real Estate Broker, DRE #02341727, dba Big Data Realty. "We" means the licensee for the state concerned. REA Platforms, Inc. provides the technology only.

2. What you get

Access to listing information that the Multiple Listing Services we participate in make available to our registered consumers, plus our analyses of it and of public records. This site operates as a Virtual Office Website under those MLSs' rules. South Florida listings are supplied by BeachesMLS, Inc. California listings are supplied by MLSListings Inc.

3. Your confirmations

By registering you confirm, and we rely on it, that: (a) you are entering a lawful consumer-broker relationship with us to receive brokerage services including listing information; it is limited to these terms, is not a buyer, seller or listing representation agreement, and creates no obligation to pay us or to transact through us (in Florida, unless we agree otherwise in a signed writing, Big Data Realty LLC works with you as a transaction broker under s. 475.278, Florida Statutes; in California any representation arises only from a separate written agreement); (b) the information is for your personal, non-commercial use; (c) you have a bona fide interest in buying, selling or leasing real estate; (d) you will not copy, redistribute or retransmit it except to consider an individual property; (e) the supplying MLS owns the listing information and its copyright.

4. Your account

Real name and a valid, confirmed email. Your username and password are yours alone; tell us if they are compromised. Credentials expire after 12 months (FL) / 3 months (CA) and renew on re-acceptance of the current terms. We keep your name, email, username and last access date for at least 180 days after expiry, as MLS rules require. We may suspend an account that breaches these terms.

5. What is shown

Not every MLS listing appears. Listings or addresses a seller has withheld from the internet are not shown; expired, withdrawn or pending listings are not shown where MLS rules restrict them; seller and occupant names and contact details, showing and security instructions, and broker-only remarks are never shown. Where a seller has asked that no automated valuation be displayed on their listing, none is. We do not display third-party comments.

6. Accuracy

Listing information comes from listing brokers, is deemed reliable but not guaranteed by us or any MLS, and may be out of date. Listings are subject to prior sale, price change or withdrawal. Verify anything you rely on. Data is refreshed at least daily; each listing shows its last update.

7. Analyses and values

Prepared with software under a licensed broker's judgment; every figure shows sample size, source and date; small samples are marked directional. No analysis is an appraisal or may be used where one is required. Any value estimate, price range or bid probability is provided only to registered users under section 3(a), for personal use, is not guaranteed, and must not be used for lending decisions. Nothing here is legal, tax or investment advice.

8. Permitted use

View, search, save and print for your own consideration of properties. Do not: use bots, scrapers or other automated access; copy, republish, sell or share the information; use it commercially, including for marketing, lead generation, competing services or model training; remove attributions or disclaimers; bypass access controls. We log logins, searches and listings viewed, including through MLS-supplied monitoring code, and the MLS may audit compliance.

9. Fair housing

We provide services without regard to any class protected by federal, Florida or California law, and we do not provide information about the demographic composition of neighborhoods.

10. Communications and privacy

We email you about your account and the services you asked for; marketing email has an unsubscribe link. Our Privacy Policy forms part of these terms.

11. Ending access

You may close your account by email at any time. We may end access for breach, at the MLS's requirement, or if our data licence changes or ends. Sections 3(b) to (e), 6, 7, 8 and 12 survive.

12. Liability

The site and information are provided as is. To the fullest extent permitted by law, neither we nor any MLS is liable for loss arising from your use of or reliance on the information, and the MLS has no liability to you.

13. Changes and law

We may update these terms; material changes are shown at your next sign-in and continued use is acceptance. Florida law and the courts of Miami-Dade County govern dealings with Big Data Realty LLC; California law and the courts of San Mateo County govern dealings with Vladimir A. Bugera dba Big Data Realty. Non-waivable consumer protections of your home state are unaffected.
